Terms of Service

These terms apply when you browse bfitsng.com or place an order with Bfits. By using the site or buying from us, you agree to them. Please read them alongside our Privacy Policy, Shipping and Returns pages, which form part of them.

Who you are contracting with

Bfits is a fashion business based in Lagos, Nigeria, selling women's and men's ready to wear, beach wear, shoes and bags. References to "we", "us" and "our" mean Bfits. References to "you" mean the person browsing the site or placing an order.

Using the site

You may browse and shop for your own personal use. You may not use the site to break the law, to interfere with how it works, to scrape it at scale, or to resell our products as if they were your own without our written agreement. If you create an account, keep your password to yourself and let us know if you think someone else has it.

All product photography, text, logos and designs on this site belong to Bfits or to the people we license them from. Please do not copy or republish them without permission.

Products

We describe and photograph every item as accurately as we can. Colours can still look slightly different from one screen to the next, and handmade or hand finished pieces vary a little from one to the next. Sizes follow the size guide shown on the product page.

Stock is limited and an item can sell out while it sits in your cart. Adding something to your cart does not reserve it.

Ordering and acceptance

When you place an order you are making an offer to buy. We will send you an acknowledgement by email confirming that we have received it. That acknowledgement is not yet acceptance. The contract between us is formed only when we confirm that your order has been accepted and is being prepared for dispatch.

We may decline an order, or cancel it after acknowledgement, if the item is out of stock, if the price or description was listed in error, if we cannot deliver to your address, or if we suspect fraud. If we decline or cancel an order you have already paid for, we will refund you in full.

Pricing and currency

All prices on this site are shown in Nigerian naira (₦) and are payable in naira. Prices include any tax we are required to charge in Nigeria unless the product page says otherwise. Delivery is charged separately and is calculated at checkout before you pay.

Prices can change at any time, but a change will never affect an order we have already accepted. If an item is listed at an obviously wrong price, we will contact you before processing the order and you can confirm at the correct price or cancel for a full refund.

For international orders, import duties, customs charges and local taxes are not included in our prices and are the responsibility of the person receiving the parcel. If your bank or card issuer converts the naira amount into another currency, the exchange rate and any conversion fee are theirs, not ours.

Payment

Card and bank payments are handled by Paystack. Your card details are entered with them directly and never reach our servers. Where we offer payment by bank transfer, your order is held until we have confirmed the funds, and we may release the items back into stock if payment is not received in reasonable time.

Orders are dispatched only once payment has cleared in full.

Delivery

Delivery cost is calculated at checkout based on the weight of your order and where it is going. Please make sure the address and phone number you give us are correct and complete, since a courier will use them to reach you. See our Shipping page for how this works.

Risk in the goods passes to you when the parcel is delivered to the address you gave us.

Cancellation, returns and exchanges

You can ask us to cancel an order at any point before it has been dispatched, and we will refund you in full. Once a parcel is on its way, our Returns policy applies instead. That page explains what can be returned, what cannot, and how to start a return or an exchange.

Nothing in these terms takes away any right you have under Nigerian consumer protection law, including the right to a remedy where goods are faulty or not as described.

Liability

We take responsibility for supplying goods that match their description and are of satisfactory quality. Where we are liable to you in connection with an order, our liability is limited to the amount you paid for that order.

We are not liable for losses that were not foreseeable, for loss of profit or business, or for delays caused by events outside our reasonable control, such as courier disruption, customs holds, industrial action or network outages. We do not exclude or limit liability for death, personal injury or fraud, or for anything else that cannot lawfully be excluded.

The site itself is provided as it is. We work to keep it available and accurate, but we do not promise it will be uninterrupted or free of error.

Privacy

How we handle your personal data is set out in our Privacy Policy, which is written to meet the Nigeria Data Protection Act 2023.

Changes to these terms

We may update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.

Governing law

These terms, and any dispute arising out of them or out of an order, are governed by the laws of the Federal Republic of Nigeria and are subject to the exclusive jurisdiction of the Nigerian courts. If any part of these terms is found to be unenforceable, the rest continues to apply.
